Terms & Conditions

Acceptance of orders
On placing an order through this website is notification that your agree with our terms and conditions. These terms and conditions will be updated occasionally, please check them before making your purchase. These terms and conditions are applicable to the supply of all products by TCGC, to the Customer. All other terms and conditions, express or implied by statute or otherwise, are excluded to the fullest extent permitted by law

Price
All prices are quoted in GBP Sterling. All prices exclude postage and packing charges, unless otherwise stated. You will be given the total price of the transaction including carriage before you complete your purchase. There are no hidden extra costs.

Price information
The Creative Gift Company has taken great care to ensure that prices listed are accurate. Our prices may be updated from time to time and sometimes may appear to be listed differently on other affiliated shopping portals and web sites. Please check our web site for up to date listed prices.

Payment
Payments must be made in Sterling only, unless otherwise specified using any of the cards shown here. You can also use Switch, Solo, Visa, Electron, Visa Delta, JCB, Solo and MasterCard. When you have completed your selections you are automatically transferred to our payment providers PayPal. As soon as the transaction is confirmed The Creative Gift Company receives an authorisation code. The secure server is acknowledged as an industry standard for applications requiring a high degree of security. After placing an order the Customer will receive an automated e-mail confirmation of order for the purchase. We validate your order and credit or debit card details you submit to us before your order can be accepted. Payment will be debited from your account within 2 days of placing your order as to reserve stock held for the customer. Passing of property: The Creative Gift Company shall retain legal title to the products until all payment has been made in full by the Customer.
Bears By Mail is owned and trades under the company name of The Creative Gift Company.

Passing of risk:
The risk on the Products shall pass to the Customer on delivery once the products have been signed for

Delivery:
Any date or period for delivery shall be considered as indicative only although if a product is in stock, we aim to send it out on your behalf to your specified delivery address within 2 days of your order. If we cannot despatch an item to you within the specified time we will notify you and at your request we will cancel the order and refund your money in full. Once the gift has been signed for at the delivery address it is no longer the responsibility of The Creative Gift Company. Refunds cannot be given if your gift is not passed on to the main recipient.

The Creative Gift Company will not be held responsible for delays in the delivery caused by the manufacturer, or any other third party.

Acceptance
The Customer shall inspect the goods within a reasonable time after their receipt. (This does not however affect the customer's statutory rights).
 
Guarantee, refunds and returned goods:
If any Products supplied should be defective or different from those ordered from the web shop will provide an immediate full refund on return of Products*. Goods exchanged or replaced for reasons other than complaint will be subject to our postage and packing charges (at cost) as stated by Royal Mail and Parcelforce. We will not accept responsibility for postal charges or lost items when returning non-defective goods. If you return a product for any other reason within 10 days a full refund will be given minus our postage and packing charge (at cost) as stated by Royal Mail.

All returned non-defective goods must be in stock condition and in the original packaging. In the circumstance where we try to deliver your gift but an incorrect delivery address has been entered on your order form, we will contact you and offer you the option to have your gift re-delivered, subject to a further shipping charge (at cost) as stated by Royal Mail. However, if you decide to cancel your order, we will refund your total payment excluding delivery charge (at cost) as stated by Royal Mail.

Cancellation of an order
If you need to cancel your order please ensure you contact customer services within 2 hours of placing your order. Please email any cancellation requests and quote your order number, surname and postcode. Cancellations will be subject to a 5% card refund administration costs.

Order Cancellation:
The Creative Gift Company reserves the right to refuse any order or part of order or to require further or better information to enable it to evaluate or process the order. The Creative Gift Company accepts no liability for any failure to ship products where this results from it inability to do so or its decision on reasonable grounds not to do so, provided it takes all reasonable steps to notify the customer within 14 days of order placement that products will not be shipped as ordered. In such cases The Creative Gift Company will immediately refund any payments made in full. The consumer has the right to cancel their order within 7 working days which starts from the day after the day the customer receives the goods except where the goods are perishable, special order or personalised items. The customer will have to pay the cost of returning the goods as stated by Royal Mail. The Creative Gift Company will refund the customers money within 30 days of cancellation.

Licence agreement:
The Customer shall respect all license agreements delivered by the copyright owners. The Creative Gift Company cannot be held responsible for any misuse constructed by the Customer or any third party.

Complaints and dispute resolution:
If the Customer has any complaint he or she should contact our customer service department. The Creative Gift Company agrees to respond promptly to all complaints in a fair and equitable manner.The Creative Gift Company and the Customer shall use their best efforts to negotiate in good faith and settle amicably any dispute that may arise out of the supply of Products or these Conditions. If the parties cannot settle any such dispute within 21 days it shall be determined by an independent third party jointly nominated by the parties ("the third party"). If the parties shall fail to nominate a Third Party within a further 7 days then the Third Party shall be nominated at the request of either party. The consumer is not compelled to take part in these proceedings. The Third Party shall act as an expert and not as an arbitrator whose decision (including as to costs) shall be final and binding upon the parties.

All brand names, product and service names and titles and copyrights used in this site are trademarks, trade names, service marks or copyrights of their respective holders.
